(“Sun Pharma,” “we,” or “us”) collects, uses, stores, and discloses Personal Information (defined below), including Personal Information gathered through this website and other Sun Pharma digital platforms (the “Sites”), Sun Pharma studies, products, and services (collectively with the Sites, the “Services”). “Personal Information” means information that relates to a natural person and directly or indirectly allows that person to be identified.
This Privacy Policy is incorporated into, and is subject to, the Terms and Conditions. By visiting the Sites or using the Services, you accept and consent to the collection, use, and disclosure of the Personal Information described in this Privacy Policy and the Terms and Conditions.

If we learn of a security system’s breach, we may attempt to notify you electronically by posting a notice on the Sites or sending an email to you. You may have a legal right to receive this notice in writing, in which case it will be communicated to you in this manner, if applicable. How do we share information?

We may share your Personal Information for the purposes described in this Privacy Policy, including:
  • We may share your Personal Information with other corporate affiliates of Sun Pharma for the functions and activities described above in relation to the purposes for which we collect your Personal Information.
  • We may disclose your Personal Information to our service providers and other third parties who process your information to provide services to us or you, including, without limitation, market research; fraud protection; data analysis; email management; and customer service. These service providers and third parties are contractually obligated to maintain the confidentiality of your Personal Information and to use it only for purposes of carrying out the business of Sun Pharma. These service providers and other third parties can be classified in the following categories:
    • Distributors, which we use to deliver our products;
    • Marketing partners, which we use to send you promotional communications;
    • IT service providers, such as our data hosting provider and companies we employ to manage our Sites and to provide Site-related services and/or to assist us in analyzing how our Sites are used; and

We reserve the right to disclose to third parties anonymized information for any lawful purpose.
Sun Pharma, our service providers and other third parties to whom we may disclose Personal Information under this Privacy Policy may perform activities outside of Canada, and outside the province of Quebec. Any Personal Information that is collected, used or disclosed in countries outside of Canada may be subject to the laws of those countries (e.g. where a third party service provider operates internationally). As a result, Personal Information may be disclosed in response to valid demands or requests from government authorities, courts, or law enforcement officials in countries outside of Canada.

Security

Sun Pharma cares about the security and confidentiality of your Personal Information. We seek to maintain commercially reasonable administrative, technical, and physical security, collection, storage, and processing measures to protect against the loss or theft, and unauthorized access, alteration, copying, use, disclosure, or destruction of the Personal Information you submit to us, the whole in a manner that is appropriate in relation to the sensitivity of your Personal Information that we collected. However, no website is completely secure, error-free, or “hacker proof.” You are responsible for taking reasonable steps to protect your Personal Information against unauthorized disclosure or misuse. We cannot guarantee that your use of our Sites or Services will be completely safe, and we cannot ensure or warrant the security of any information you provide to us. We do not accept liability for unintentional disclosure. We are not responsible for third-party circumvention of any privacy settings or security measures. Children

We do not knowingly collect or store Personal Information from anyone under the age of 14 unless or except as permitted by law. ANY PERSON WHO VISITS ANY OF THE SITES OR USES THE SERVICES REPRESENTS TO US THAT HE OR SHE IS 14 YEARS OF AGE OR OLDER. If we are made aware that we have received Personal Information from someone under 14, we will use reasonable efforts to remove that information from our records.

Updating your information and other rights you have

In accordance with applicable law, you have the right to access and update your Personal Information, as well as, insofar as applicable, the right to request its deletion. To keep your Personal Information current and accurate, please contact us as specified above. If you decide to email us to update your Personal Information, please include the words “Updating Personal Information” in the subject line. We will take reasonable steps to update or correct Personal Information in our possession that you have previously submitted via the Sites or Services
You have the right to request that we cease disseminating your Personal Information if the dissemination is contrary to the law or a court order. You also have the right to request that we cease disseminating your Personal Information where the following conditions are met:
  1. the dissemination of the information causes you serious injury in relation to your right to have your reputation or privacy respected;
  2. the injury is clearly greater than the public’s interest in knowing the information or of any person’s right to express themselves freely; and
  3. the cessation of dissemination requested does not exceed what is necessary for preventing the perpetuation of the injury.
You have the right to request that we de-index any hyperlink attached to your name that provide access to information by a technological means if such access is contrary to the law or a court order. You also have the right to request that we de-index a link providing access to information where the following conditions are met:
  1. the availability of the information causes you serious injury in relation to your right to have your reputation or privacy respected;
  2. the injury is clearly greater than the public’s interest in knowing the information or of any person’s right to express themselves freely; and
  3. the de-indexation requested does not exceed what is necessary for preventing the perpetuation of the injury.
You also have the right to request that we re-index a link providing access to information where the following conditions are met:
  1. a failure to do so causes you serious injury in relation to your right to have your reputation or privacy respected;
  2. the injury caused by a failure to re-index is greater than the public’s interest in knowing the information or of any person’s right to express themselves freely; and
  3. the re-indexation requested does not exceed what is necessary for preventing the perpetuation of the injury.
You have the right to request that computerized Personal Information collected from you be communicated to you in a commonly used technological format as well as to any person or body authorized by law to collect such information. This right does not extend to information that was created or inferred from your Personal Information and we are under no obligation to communicate such information if doing so raises serious practical difficulties.

Data Retention

We may store your Personal Information at our offices in Brampton, Ontario, Canada.
Except to the extent prohibited by law, and subject to this Privacy Policy, we will retain your information for as long as needed to provide you with the Services, for Sun Pharma’s legitimate and specific business purposes for which your Personal Information was collected and processed, and as necessary to comply with our legal obligations, resolve disputes, defend our legal rights, and enforce our agreements. Where we process Personal Information for marketing purposes with your consent, we will continue to process the data until you notify us that you wish to unsubscribe to future contact, except to the extent prohibited by applicable law. Where you do notify us that you wish to unsubscribe to further contact, we will keep a record of the fact that you have asked us not to send you direct marketing communications so that we can respect your request in the future.
Where we process Personal Information to meet legal requirements, we will hold this for as long as the law requires (for example, we may hold records to help prevent fraud and other prohibited or illegal activities).
Upon expiry of the applicable retention period, we will securely destroy your Personal Information in compliance with applicable laws and regulations.

Complaints

Any report, concern, complaint or incident of which we become aware that involves conduct that may contravene this Privacy Policy will be treated confidentially to the extent possible. However, some disclosure may be necessary to adequately address issues raised, aid enquiry and implement solutions, as appropriate.

How does this policy apply outside of Canada?

The information collected by Sun Pharma may be hosted in Canada and is subject to provincial and federal law, as applicable. If you are accessing the Sites from other jurisdictions, please be advised that you are transferring your Personal Information to us in Canada where data protection and privacy laws may be less stringent than the laws of your country. Severability

If any provision of this Privacy Policy or any updated Privacy Policy is held to be unlawful, void or unenforceable, then such provision shall be severable without affecting the enforceability of all remaining provisions.
